The Conewago Township Board of Supervisors held their regular meeting Wednesday, October 8, 2003. Those present were:

The meeting was called to order by Chairman Graybill at 7:45 PM. Prior to this meeting there was an Executive Session to discuss legal issues.
MINUTES OF AUGUST 13, 2003 - Motion by Rochat second by Graybill to approve minutes of August 13, 2003 as submitted. Motion carried.
MINUTES OF SEPTEMBER 10, 2003 - Motion by Rochat second by Graybill to approve the minutes of September 10, 2003 as submitted. Motion carried.
TREASURER'S REPORT - SEPTEMBER 30, 2003 - A motion by Brandt second by Rochat to approve the Treasurer's Report dated September 30, 2003, subject to audit. Motion carried.
EXPENDITURE REPORT - OCTOBER 8, 2003 - A motion by Graybill second by Rochat to approve the expenditure report dated October 8, 2003 in the amount of $48,576.91. Motion carried.
SUBDIVISION/ENGINEERING FEES - Billing all up-to-date
PLANNING COMMISSION MINUTES - SEPTEMBER 29, 2003 - For review only.
PUBLIC COMMENT PERIOD - Rosalie Sarfert, Laurel Woods wanted to know when the township will start collecting leaves. The maintenance department is getting equipment ready for leaf pickup. Kim Bloom, DTMA will check with contractor regarding collection of leaves with township maintenance, all leaves should be at curb for pickup.
PROPERTY MAINTENANCE ORDINANCE - No Progress on this Ordinance until PENNVEST issues are resolved.
STATUS - DTMA - Kim Bloom said they haven't had any complaints. Their next meeting with the contractor, she will be thanking them on behalf of DTMA and BOS for their cleanup after Hurricane Isabel. Rochat said the contractors are doing a fine job, but would like Kim to mention concerns for West Nile Virus because of water in low lying areas
DTMA will be sending Grant Applications for those resident who may be eligible for the County Grant money to help with financing of connection cost for sewage system... The county changed their fiscal year, so they will modify form for residents, but money will not apply until 2005. Forty six percent of residents in the project area must meet the income guidelines to be eligible for grant money. If application is approved through county program the money would be available only to those families who qualify.
OLDS MANAGEMENT PROGRAM - The solicitor send letters of reminder to five residents for the year 2001 and 2002, who did not comply with inspection/pumping reports. If no response is received the solicitor will serve them with a legal notice.
SEXUALLY ORIENTED BUSINESS ORDINANCE - The zoning officer provided Rochat with a copy of revision of Sexually Oriented Business Ordinance to look at again. Rochat would like the words "regular and "primary" taken out of ordinance. The solicitor will review and decide how words should be used legally in the ordinance. Put on November Meeting Agenda.
PENN'S VALLEY - UPDATE CODE OF ORDINANCE - Burton E. Hunt -We received a letter for cost estimate to supplement Township of Conewago Code of Ordinances. Based on Mr. Hunt's review the cost would be $15.00 per revised/added page, not to exceed $420.00. The cost could be less depending on the final page count. They would have replacement sets of pages to the Township within 45 days of receiving authorization to proceed from the Township. Mr. Hunt also recommended that if we anticipate adopting a few ordinances in the next couple of months, postponing the supplement would be prudent. The solicitor suggested that since we do have a few policies and/or resolutions in the making we should wait until end of year. Put on Dember Meeting Agenda.
ACCEPTANCE OF DEDICATION OF RIGHT-OF-WAY - The engineer gave the Board a Dedication of Right-of-Way Policy to read. and review. The time to accept a right-of-way would be at time of recording of the subdivision plan. Our present ordinance for dedication of right-of-way is adequate and we could adopt this as a policy, and go back 21 year's copy subdivisions, reference the plan, and a legal agreement should be, drawn up. The solicitor said we don't have to get property owner signature, we could adopt as a resolution to second township code, that we are now accepting that which was previously offered, record and give to Clerk of Court. Put on November Meeting Agenda and also Planning Commission Agenda for October.
ELECTRICAL COMPANY SERVICES/PUC - John Rochat - Rochat said in reference to Hurricane Isabel he had several complaints from residents regarding NO electrical service for several days. There was an allegation that Met-Ed send employees home because they did not want to pay employees overtime. Rochat talked with Rep. Payne and he said there is a formal complaint process. A motion by Graybill second by Rochat to file a complaint with PUC regarding inadequate service due to regfusal to pay employees overtime. Motion carried.
BUILDING PERMIT/SEWAGE PERMIT COORDINATION - Max Shradley - The engineer gave the Board a proposed township policy for sewered areas of the township. Condition One - Public Sewers Constructed and Operational. Condition Two - Public Sewers Under Construction and/or Not Operational. The solicitor will draw up a waiver that owner assumes risk, if he can't hookup or takes longer than anticipated that the owner can't come back on township or DTMA. The engineer will make changes to language and see the solicitor and DTMA get a copy to review, Put on November Meeting Agenda.
HILLS OF WATERFORD Subdivision Revision - Greg Hill - Cancelled for this meeting. The engineer talked to Greg Hill before meeting, and they ran into 32,000 cubic yards of hard rock which needs to be excavated. The contractor planned to use the fill from that area for other areas of development. They weren't sure what to do but have decided to record this plan and came back with a revision to plan. The final subdivision plans has been signed by Londonderry and the plan was brought to township building this week for Conewago signatures. The engineer gave them copy of what is due for escrow and outstanding item are fees for curbs, sidewalks and widening along Roundtop. As soon as township receives escrow check the plan is ready to be recorded, and the solicitor said since final plan is over 90 days that a statement should be on the plan that conditions of approval have been met on such and such a date.
PROCESS FOR RECORDING SUBDIVISION PLANS MORE THAN 90 DAYS OF APPROVAL - The solicitor said the process with county and state has legislation subdivision plan must be recorded in 90 days, they amended, but never told anybody what to do. The courthouse would be satisfied with language saying "Condition of Final Approval of Plan was met on such and such a date", and authorize township secretary to sign. This should be standard procedure and a special block on plan for those subdivisions over 90 days, if needed. This should be added to Subdivision Plan Ordinance.
FIRE COMPANY DONATION - Every year the Fire Relief Fund sends the township a check to be distributed to the five companies who protect our township. This year the amount for each fire company is $3811.05 and also the township usually donates to the five fire companies, in November to show our appreciation of their protection to our township. Last year we donated $6,000 to each fire company. A motion by Graybill second Rochat to donate $6,000. to the five fire companies. Motion carried.
BUDGET DATE - The Board set the date for a special meeting November 5, 2003 to discuss proposed budget for 2004. A legal ad needs to be advertised in The Sun prior to this meeting
Rochat asked the zoning officer if he has prepared a Park and Recreation Plan Ordinance . The zoning officer initiated the study and made some headway, but recognizing the need because sewers going in, and potential development in that area we do need this ordinance adopted. If we want to collect fee in lieu of, you would need the Park and Recreation Plan to support that activity.
Rochat also reviewed the Health Insurance fee for two employees which cost $21,197.40/year. The current Plan is Plan A and indemnity plan with $200. deductible. Plan B - the PPO plan is a better plan and is cheaper, does not have a deductible and a $10.00 co-pay for doctor, but you must stay in the network with coverage of 100%, out of network policy is 80%. Rochat talked to Trustee Insurance Conpany and said there is a deadline of November 1, to change plan and that if we choose to change they would give us a credit for payment already received. A motion by Graybill and second by Rochat to approve change to Health Insurance Plan on condition that Brandt is satisfied. Motion carried.
A motion by Chairman Graybill second by Rochat to adjourn at 9:00 PM. The next meeting is November 12, 2003.
